    Lol sorry flamingparrot, you do keep saying proof is on them. I am dizty at the best of times 😕 I just know they will show the credit card statements that shows the money was paid from the current account I had with Lloyds, but then I suppose that will then be my place to show that Lloyds took those payments themselves. Can't wait until this is over with now, it seems to be moving along quickly.

      Yes, it's always good to have a counter-argument. :thumb:

      Bear in mind the mediation service are just intermediaries, not judges. All they can do is go back and forth from one side to the other, they can't decide whether the debt is SBd or not based on any evidence put forward by either party. Only a court can rule on that. :juge: If mediation fails, the matter will proceed to court.

        Hello! So I now have a court date. It also says on the letter that I have to send any paper work I will be relying on to the court and Lowell and if I don't do so, the judge may not consider it as evidence. Obviously I want to use the SAR paperwork from Lloyds to prove it is SB (I know burdern of proof is on them but I am guessing it's highly likely that they may have the statments saying I had paid money to that account, so I want to used the papers from Lloyds showing Lloyds took the payments out themselves) so do I send all of that now? I don't have any idea how this works. If so, do I write a letter to say what the papers show and explain?

        And is there any other way I should prepare for the court hearing?

            Lowell sent me a notification of Discontinuance, I phoned the court this morning to double check and they confirmed it. I could not have done this without this site. Thank you all so much :grouphug:
