    This may be a stange one ile try to be brief
    I was in care in 92 in a home went on a holiday ended up in a really freach accident a ride that nearly cost my life a big compay owned it ,I was led to belive socail serives sued as the company another fault the brake on the ride appently was broke even before I got on it I fly of the tracks and went mid air and was bradly hurt rushed to hosptail ,

    I was lead to belive a claim was put on by the s/ s I never though more of it and was told if a claim was given I would get 18 ,
    i got on with my life marred children etc ,
    recently I got my files and half missing , stuff about this accident and others things happen in the home
    I emailed the local area team and the big co rang me he said how bad it was their should claimed duty of care etc now my other part of my files get if looked for to see if out in there , today been confirmed the courts hold no funds no claim was ever put in this was a clear cut case back then as how bad the accident went the ride did get close down for 7 years only opened in 2010

    i have apgathered evidance to this last few days ,my medical notes my gp confirms there was a accident in 92 i says were and the children home took me to do gp for pain relief afrer as I was really ill , and badly hurt took six mth to recover spent time dog collar wasnt allowned it of for good three mth scaring to my face list goes on , the home took pictures of me and the site as when I fly thou the air I landed and took a hut pannel out r,
    I have got a witness who was there at the timethis person I not seen for 20 years so totally impartail , I also got names of career from the home who was looking after me ,and was there accident ,

    i was never told once no claim was never put in the socail serives let this go ststus Barr and lost my claim to claim as I thought it was put in i was led to
    belive was ,

    i spoken to a legsl firm willing to take it to a no win no fee she said she take it on as its a case I would win on tottaly failure duty care plus I have prove my medical gp notes

    socail serives big boss is trying is hardest to find there files and this information. As he said legal there have to be kept for 85 years there was three admissions I was in the home one for the accident , one loss of a babys, and obe other one due to hesth issues none logged in ,y s/ s records or there lost this would come under data protection which there can get fined for ,
    lawyer says I have a strong case as the balance of possblites is on my side and due to it seems there lost the file and never folloed legsl produes to this case in 92 is a lack duty of care as if a child had a accident to this scale amy parent would seek justice , s/s was my care givers failed me

    on the above info does amy one think I got a strong case to claim damages agaist s/s for the loss that I could got from this accident due to there tottsly failure in meeting the needs of a child in there care looking for advice thanks do you think I should get legal involved or ask for a companion without taking it to court as no s/s would like this in court please help thanks

    Well Stacy I know nothing about the law and the more judgements I read the more confused I get! However, in my humble and very ignorant opinion I think you should pursue this. I think you are going in the right direction by seeing a solicitor. Social Services had a duty of care and they were very negligent if you ask me so I would ‘sock it to them’. To be honest, the fact that there is a chunk of your file missing is very, very fishy.
    Go for it, you have nothing to lose and try not to get down if it drags on. Good luck to you and keep us posted on your progress.

      Hi thanks

      I summited my claim against North yorkshire counil , the missing files have been found but some resons there with a tottaly diffrent concil so thats a date PROCTENTION Oder investigation to , was never under them stange and worring there is some thing in there about the accident which proves I not laying but now there no idea how to get the files relised to the right counil office as it been laying with a diffrent one for Many years , clearly messed up there
      I have obtain my medical note from gp there a note in from gp I attened to gp with socail worker about accent and the socail worker it states told gp he get reports toghter about the accident clearly there did not so there a full investage ion now and I put a claim on for damages to what I woud of got so wait ot game now ,

        You could try a SAR request to the council for your data (https://ico.org.uk/for-organisations...ccess-request/) that way you'll have the files yourself ...

        or; have a word with your MP and see if they can pressure your council to retrieve them at their own cost??

          I've asked for them but at moment there sit with a counil thst did not have nothing to do with my care as a child there a big why to why there sat there between diffrent county's
          mp not be good helping as we forces so not in the local areas ,
          i letting the investigation happen if I don't get what iam looking for my solitor taking it over x

            Bless you, Stacy - I hope this finally goes well for you. It takes courage to do what you're doing but it's the right thing and with any luck it will help close yet another appalling loophole in the "care" system whereby the most vulnerable and trusting amongst us get their needs neglected.

              Thanks to be far it was a radam thought and I emiled just coz I was more bored to be fair , but now I open a high can of worms on it
              my files were not even right s/s place which is date Loss a big cocern ,
              i got it in my gp notes I was under i attened the gp not long after with a carer from the homes after the accident states socail worker would get the reports to doctor did not follow this thou , I alos have a witness who I not heard of in 20 years who said willing to stste happened accident , I lucky to be here , this company is a big we'll know company ,
              i was lead to belive of my socail worker there sued etc clearly never I just took the word there did as u expect a child to ,
              I just shocked how lax there are no wonder this govement a mess pretending children
              i,, I thought it be a easy case but now made a load of work for the council I seeking loss damages for, lol
