    Hello again, sorry for the late reply Flaming.

    I've sent my WS one day last week, and today i receive form N244N from WH, please see below.


    That the Court use its Case Management Powers under CPR 3.1(2)(a) and the overriding objective to grant a 60 day extension to the Order of District Judge xxxxxx dated 8 July 2015 to allow the Claimant further time to obtain the necessary documents to evidence its claim, and a corresponding adjournment under CPR 3.1(2)(b) to the hearing listed for 10.00 am on xx October 2015.

    The Order of District Judge xxxx dated xxxxxxx requires each party to deliver to the other party copies of all documents upon which that party intends to rely upon by xxxxxxxxx. The Claimant has requested this documentation from the original vendor but these documents have not yet been received. The Claimant has been advised that it may-take a~further-8~weeks-to obtain these documents. The-Claimant is therefore unable to meet this deadline and requests that an extension of 60 days be granted under CPR 3.1(2)(a) in accordance with the overriding objective in order to assist the parties in keeping the costs in this matter as proportionate as possible.
    The Claimant also requests a corresponding adjournment to the hearing listed for 10:00 am on xx October 2015 under CPR 3.1 (2)(b) in accordance with the overriding objective. Such an order would allow the Claimant to provide the documents to the Defendant, which will encourage further exploration of alternative dispute resolution options,will prevent any prejudice arising to other Court users by wasting the Court's time, and ensure that a just and fair outcome for both parties can be reached.
    This extension will grant the Claimant more time in which to obtain documents that it has requested from the original creditor and upon which it seeks to rely, and will encourage any alternative dispute resolution options.

      I'll translate that for you, shall I? In plain English, Crapbot can't get the original creditor who sold the account ages ago and is no longer interested since they don't stand to gain from any judgment that Crapbot may obtain, to supply them with the documents they need to evidence this claim. They have therefore applied to the court for an extension of time to see if they can whip something up so the hearing scheduled for October has been re-listed to a later date. They still have to provide you with the documents before the hearing. They requested a 60 day extension from a date in October which should take it to Christmas, si it'll probably be next year. :carolers:

      Unfortunately the court has been generous and granted a 60 day extension. :rant: :mad2:

        Thanks for your reply, but i don't think the court has granted the 60 day extension yet, i'm going to scan the form i received from Wright Hassall where i copy the text i posted above.

                NOPE! Not at all!

                The have applied to the court for more time to obtain the documents. As part of the process, when a party makes an application the other party has to be notified and that's what's happening here. It means they're struggling but don't want to give up just yet.

                Debt purchasers buy accounts as job lots without acquiring the paperwork. The issue claims in the hope of obtaining default judgment which doesn't require paperwork. If someone files a defence, they have to go back to the original creditor to obtain the documents. The OC would be in no rush to dig up the paperwork for an account that was sold and written off by them. That leaves the claimants in an uncertain position, since getting hold of the evidence requested is completely out of their hands. They may have been told by the OC that they could get the paperwork but it will take time to retrieve.

                If they've not been able to come up with the goods thus far, their prospects of obtaining them in the next 60 days aren't looking that great but they're still trying, bless them. :lol:
