Morning kati, thank you very much. I have emailed you the documents received from BW. There should be 3 emails in total with "lte69" in the subject box.

Once again thank you for your assistance.

            Morning Nem,

I have emailed all the photos to Kati.

I have just noticed on the paperwork "sent" by British Credit Trust was sent to my old address. The date on the letter July 22, 2013. Now, I find this most bizarre because I left there in 2009. British Credit Trust knew this because I informed them that I had moved when I handed the car back, and I have had letters from there to my new address since I moved in 2009. I do question as to whether this is something that BW/Lowell have typed up themselves???

Hmmm sounds like someone has perhaps tried to reconstruct a document and has got the dates wrong.

I'm in and out of LB at the moment as I have a " techy" checking on a number of matters for me.

Just a few observations and maybe you have received the documents

                        1) there does not appear to be a default notice only a notice of sums in arrears. The default notice is needed for them to proceed

                        2) You said earlier that it appears on your credit file under capquest therefore there should be at least two NOA's , 1 from BCT to capquest and another from capquest to lowells ( unless there has been a merger I am not aware of) Last I knew capquest were owned by Arrow global . There does not seem to be 1 notice of assignment let alone 2-also that would make the POC incorrect

                        3) It is interesting that you said that the supposed letter from BCT was sent to you old address, another company have been up to the trick of forging letters see point 4 https://consumercreditlitigationandd...lp-lose-again/

                        Hope they help

                          Hi Bernie,

This is all new to me and I am in a little bit over my head if I am honest. There isn't no credit agreement either which I requested.

Yes on my credit file the debt is assigned to Capquest......even the balance is different on my credit file. The amount owing on my credit file is somewhere in the region of £3995??? Like I said, its a little bit over my head!

The first lot of attachments, two of them just state their intention to proceed with the claim, the other two are pages from a letter where they are offering a 20% discount to settle out of court. I don't think this is a very generous offer. :mmph:

The last one is just a generic notice of sums in arrears.

Nothing significant here with the second lot either, just a statement, another notice of sums in arrears and proposed small claims allocation.

Was a bit concerned with I saw all those attachments, :ohwell: thinking they had somehow managed to whip up all the documents but I can see there are none.

No agreement, no NoA or DN which are the documents that would have been requested under CPR 31.14 and which they should be directed to provide at least 14 days prior to the hearing by the court. :juge:

No response to the CCA request either so nothing changes. :thumb:  :thumb:

Was reserving further comment on the without prejudice offer till I'd seen the rest of the documents, having seen them, or, more accurately, not seen any of the relevant ones, I can't think of one good reason to accept! :nono:
