This would be a good time to start drafting your witness statement.

    Thanks Nem.

Sorry for sounding clueless, but what how do I go about writing my witness statement?

Did you see my post above this one? About what my credit file says?

    Kind regards.

Looking back at the claim form it seems that the credit file entry has not been properly updated BCT were somewhat sloppy in this area.

Witness statement is " your story " of the events giving rise to the claim formalised into paragraphs similar to a defence.

Have a look at some other threads with witness statements it will give you a better idea of format and wording.

Thank you. This really is frazzling my brain and make me feel anxious, still not had nothing from BW or Lowell. I am really struggling with this witness statement if I am honest. Any advice is appreciated.

Why don't you post up your draft on here so we can take a look at it and comment accordingly? :typing:

              Thanks FP.

Have I not already sent my defence in to the court? I am confused I have to say. I thought that was what I had emailed to the court 2/3 weeks ago or was that something else?

Sorry for coming across as dumb.

Defence acknowledged and sent to claimant your post 5th August confirms.
When actually did you send the defence in?

Nope, you're not the dumb one, it's me!

I read a lot of similar threads so it's easy to get things a little mixed-up at times.

I can imagine it's a job in itself when you are helping so many people with the similar problem all at the same time. I for one appreciate your time and advice.

                        Morning nem.

Right, I have had communication back from BW and the Court. BW haven't sent me the credit agreement as requested but I will post what I have received from them and the court now. So just bare with me, I'm getting to grips with Windows 10 and how it works with the iPhone.

Yes that is exactly what they have sent me!!

I should have said they HAVEN'T sent me the credit agreement as requested. I am still trying to upload the photos but as I said above, WIndows 10 isn't playing ball!

It's a standard template that's become popular with DCA's " tame solicitors" challenge this as CPR 31 .14 is relevant until the claim is allocated to the SCT. ( letter in forum library).
No news on the CCA request? ( Don't chase that!)
