Advice needed! I have 2 CCJ's for same debt. Welcome Finance & Cabot

    Basically from all the advice I received on here I kept on a Cabot to sort it out. It was plain to see what they had done was wrong but you try explaining that to a load of minimum wage pen pushers. Eventually I spoke to a young lady at Cabot who made a huge effort to see that this got investigated properly. A few weeks went by when I received a letter from them stating they were going to apply to have the judgment set aside. Happy days! So I left them to it for 4 weeks to go by and still no update. Turns out their solicitors Weightmans enclosed the wrong fee to the court and didn't sign section 10 so they have to reapply. Hoping it will all be sorted in a few weeks.

    Serious us amount of headache and stress though for something clean cut.

    Yours doesnt sound right, you can't have 2 judgments for the same debt.

    Absolutly brilliant people on here, with a huge wealth of knowledge that will be able to advise you.

      Hi, Marc… thanks for the post.

      I don't know how it works, but to cut a long story short, I owe legal costs and the creditor applied for a charging order. The court granted a form k restriction against my half of a jointly owned property.

      Then the creditor made another (without notice application) stating that the original CO did not protect their claim and asked for a modified CO.

      I tried to get this overturned as I thought that it was impossible to challenge an Order once it has been sealed. The creditor would have needed to appeal the original order.

      I applied for set aside but at court, I was told the original order had not been challenged and still stands but that there is now a second (modified) CO in addition to the first.

      Two CCGs for the same debt!
