I appreciate what you’re saying but the outcome is either going to be that I owe this money or that I don’t, isn’t it? I’ve seen the witness statement and it doesn’t appear to be dodgy to me. Remember, the Claimant is not going to be represented at the Hearing and will be relying on the evidence I’ve seen.

Any comments before the morning Amethyst?

Re: Court Claim - Lowell Portfolio I Ltd / Capital One - 19-5-2015

      Hi people,

As I indicated, I didn't go to the hearing on 18 November and have been expecting a letter from the court saying a decision has been made against me.

What I’ve just received instead though is a General Form of Judgment or Order stating:

      IT IS ORDERED THAT

      1. The Claim be stayed

      2. Unless an application is made to lift the stay by 4pm 29th January 2016 then the
claim shall stand struck out by this Order

Has anyone got any idea why the claim would have been stayed? And how unlikely is it that an application to lift the stay won’t be made?

      Thanks.

It could be because no one from Lowell/Bryan Carter turned up for the hearing either.

OK I can only guess that the claimant has either failed to comply with a judges directions an has asked for a stay to allow them to attempt to comply with an order.
Or the courts of it's own volition has decided there is a deadlock or there is at present insufficient evidence at the point to warrant the claim going forward to trial.

You could ask the court for an explanation of course.

It is possible, if that is the case though I would think that Carter would have asked the court to rule on " the papers " submitted to the court.
