    Hi, I'm hoping someone can shed a little light on my confusion (and also hoping this is in the correct section of the forum, lol)

    Yesterday I petitioned for (and was granted) bankruptcy. All ok there, I paid my £705 fee and everything went without a hitch.

    I later on found out - thanks to this forum - about form EX160 and after reading the guidance notes would seem I'm eligible, which is handy as I also have to file for the dissolution of my civil partnership.

    My quandry is this: Regarding being part of a couple, filing for dissolution is not a problem as it falls into the contrary interest bracket. However I'm also looking at applying for a retrospective application for a refund of the court fees I paid for the bankruptcy. It would appear that I would have to list myself as part of a couple, because of being in a civil partnership. However the guidance notes also state that I'd be defined as single because I don't live with my partner and rely on my own income. So I'm a little confused as to which of these definitions apply to me. Any chance somebody could clarify this for me?

    The other problem with this is that I have absolutely no idea of his gross monthly income and have no way to find out, so I'm a little stumped if I have to list it on the form. Any and all help would be greatly appreciated.

    (Of course none of this would be an issue if I'd known I could have filed for dissolution first, knowing EX160 would apply to me. Oh well, you live and learn, lol)

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
