    Hi All

    I received a Court Order for Costs of £1958.28 on 26 January 2015 which I paid in Cash to the Creditor. The Creditor is trying to return via a cheque claiming that it is not in full and final settlement. I have not encashed cheque and remains in account of lawyer acting for management Co. I then emailed by HM Land Registry 8 April that a B10 Notice on my property. I was then served 17 April Bankruptcy Petition on Failure to comply with Statutory Demand for Service Charges. The Creditor's application does not mention B10. However, I do not owe the money as the Management Co. is disregarding a Court Judgement LVT 2010 that no service charge payable unless and until Annual Audited Accounts are produced in accordance with the Lease. The Management Co. has not complied with the Lease for Annual Audited Accounts for several years. The Petition Hearing 12 May. I have sent Written Statement and Form 6.19 to Oppose the Action. CAB said to write to the District Judge that management co. is not complying with the Lease and will send via Recorded tomorrow. I am a shareholder of the management Co. which is a Trust holding the flat for the Lessor who is a Housing Association and exempt charity who transferred its interest to the management Co. in 2013. I own my flat outright.

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
