    Hi Bluebox.

    The mediation process is expected these days so the parties to a claim
    can attempt to settle without a court hearing.
    Nothing that is discussed in the mediation process can be used in court
    if the mediation fails.

      CCA as in the agreement? That's the one posted previously, plus default notice.

        Has anyone looked at the CCA yet and given an opinion on it's validity?

          No, they haven't. However, it's more involved that that as following a s78 request MBNA were never able to send me a legible version of the 'Signature Form' which appeared it might include the prescribed terms nor did they include the actual full terms and conditions. That was still being chased even as they defaulted the account.

          Equally, I complained about the timing and amount of the default notice and all I ever got was holding letters despite sending them over a period of months 3 or 4 reminders that the matter was still outstanding.

          Should add that the CCA attached above was from a blown-up one that was sent after the claim was issued. Why MBNA couldn't manage that I don't know.

          Acknowledge Claim - within 14 days from Service

          Defend Claim - within 28 days from Service (IF you acknowledged in time)

          If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
