  • CCJ or just a Tomlinson

    Hello all,

I had a Tomlinson order of which I am paying RESTONS a small amount per month.

Is this an actual CCJ, I did receive a court letter, but never dealt with them, I called Restons and said look ill pay you X amount a month, they were happy with offer and wrote to court.

I am guessing, they wrote to court to stop notice ?

    Regards

A " Tomlin" (consent) Order is an agreement accepted by both parties and sealed by the court, it is binding on both parties and avoids the issue of a CCJ.
If the debtor fails to maintain the agreed payments the creditor can apply for summary judgement, and a CCJ will made.

I don't understand your last part about writing to the court?

You should have a sealed copy of the Tomlin Order.
