  • Re: Court claim - rent arrears

Hi, any more thoughts on this? I think what's I'm trying to determine is...

    1) Do I NEED to make this first payment even if I am querying/ not happy with the amount in order to avoid employer being contacted?

    2) When the CTAEO is set up, can I make the calculations under the suspended order to ensure I don't receive less than the minimum amount stated on the form? Will I need to tell the claimant or their representative each time?

    3) Do I have an argument to the court to reduce the monthly amount? I still can't figure out where the £170 has come from.

    Thanks

      Hi all,

Apologies for chasing but any thoughts on my next move? To complicate matters further it seems like the council are willing to come to a payment arrangement for the council tax arrears and not set up the CTAOE.

I'm sorry but this is now a very long thread which I haven't been following.

Could you summarise with a list of your current debts, noting which ones have payment arrangements in place. Also say how much you think you can afford to pay towards your debts in total each month. This thread is headed "rent arrears" are these on your current home?

If you can avoid a CTAOE you should as they deduct very large amounts. It would be unusual to be able to pay much to any other debts if you have one in place.

          1. Yes to show good faith that you are attempting to meet the debt.
          2. The payments will be fixed monthly amounts. Set at an amount ensuring that you have least that minimum income.
          3. You can ask the court to re determine the payment level on the grounds
          of hardship.

Thanks for the responses. I'm still not sure what I'm doing.

Hopefully I can ask one more thing. As the amount is now just over £5,000, can they start adding interest as it suggests on the order I have? How does that work? Who calculates that? If I make the first payment, that takes the balance below £5,000 (without any more interest added), does that change things? I should mention some interest was added when the original judgement was made.

            Thanks
