    Particulars of Claim:
    This claim is for the sum of £2400 in respect of monies owing
    pursuant to an overdraft facility under a/c number xxxxxxxx
    The debt was legally assigned by Santander UK PLC to the claimant
    and notice has been served. The defendant has failed to repay
    overdrawn sums owing under terms and conditions of the bank account.
    The claimant claims
    1. The sum of £2400
    2. Intersest persuant to s69 of the county court act 1984 at a rate
    of 8.00 percent from the 3/02/15 to the date hereof
    13 days is the sum of 7.29
    3. Daily interest at the rate of .56

    Original overdraft was for £250, after changing jobs and taking a cut
    in pay and various other things going on at the time i exceded my limit
    charges got of hand, direct debits going out then being returned etc it
    soon built up. i foolishly chose to ignore it and other accounts as it got to much.
    this was back in 2010 and didnt hear much ater the default apart from
    the odd statemnt just showing the balance until recent when i recieved letters
    saying id have a cc request if i didnt reply to the letters,
    then the court claim forms arrived yesterday. I dont want a ccj ofcourse
    and want to pay it off but would like to know how it got to £2400 and
    plus further costs now. last payment on the account or contact
    would have been a few months before the default 2/6/2010. i cant afford
    to pay it off in one so would have to be installments. I have no experience
    with cc action and dont know what to do next. i have read the basics on here
    but am still a bit lost. any help or guidance will be appreciated. thanks

    Howard Cohen seem to be on a roll, issuing claims left, right and centre.

    Sadly if you paid in 2010, this wouldn't be SBd yet

    The problem with overdrafts is that they just seem to pile on charges on top of charges. :rant: :rant: :rant: :rant:

    Your first step should be to acknowledge the claim, which you should be able to do online using the P/W provided. You must do this within 14 days. For now say you intend to defend the whole of the claim, that should give you an additional 14 days to submit a defence, a total of 33 days from date on claim including 5 days allowed for service. :clock:

    Being a current account overdraft, the CCA request you may have heard so much about wouldn't apply, however, you can still send a request under CPR 31.14 for documents such as this one here: http://www.legalbeagles.info/forums/...ht=#post409682

      hi thanks for the reply, i will acknowledge the claim and send the cpr form off tomorrow . On the cpr form i have to insert case number. is that the claim number B1****** on the claim form or is that something diffferent. just want make sure im sending the correct number. thanks

        Hi, I've had the same claim form sent to me issued 19th feb 2015 claimant- Hoist Portfolio holding 2 limited.

        they are claiming quote..." £2102.98 in respect of monies owing pursuant to the consumer credit act 1974 (CCA) under account number xxxxxxxx
        the debt was legally assigned by Santander UK PLC to the claimant and the notice had been served. The defendent has failed to make contracteual payments under the terms of the agreement. A default notice has been served upon the defendant pursuant to section 87(1) CCA.

        This debt I believe is from a loan which I believe may be SB as although I'm not sure of the dates it is certainly over 6 years since any payments or acknowledgment had been made on this debt.

        Please se could someone give me some advice on what to do now? My credit score is improving and I do not want to recieve a CCJ for this.
