  • Court Claim - Arrow global limited / EGG I think - 3-2-2015

    Hi All, I am new to the site, can anybody help?
    The above are chasing me for a debt of over £11,000, I have never taken out any agreements with them, I received a letter from the county court the other day, they are using a solicitor called WILKIN CHAPMAN, I have checked them both out, they are debt recovery people, I have never acknowledged any letters from either of them, I am 64 and this is making me ill, I am concerned about a debt I had back in 2004 with EGG, I think this may be connected, can I claim Statute Barred? As I said I have never acknowledged any letters for over 10 years from any of these people. I checked out Experium last year and there was no sign of this debt on there site then. Any ideas?

    If from that length of time ago then it would not be on your credit files now, and could be statute barred.

    What letter did you get from the court? An N1 claim form?

      Hello Roger,

      Start by checking your credit reference files (Noddle is free online).

      Statute Barred in England and Wales = No payments or unequivocal written acknowledgment of the debt in 6 clear years.

      For clarity the 6 year clock starts ticking " when a contractual payment was due and not made, after which no further payment or written acknowledgment was ever made."

          Thanks, I really am new to these sites, I had some problems many years back and thought I was clear of these problems, I think it may be something to do with an EGG card I had back in 2004. I will do as you have suggested and fill in the form, I am quite happy to give a profile, when I sus how to do it, once again thanks. Roger

            I have not spoken to anybody, or paid any payments for a good ten years,any strange letters I ever get are returned unopened, I received the county court letter dated 3/2/15 4 days later and decided to open it, I have spoken to a debt agency and she feels I have a good case for statute barred, I have a template letter I got from net and was thinking of sending back to the court defending the case.               The claimant's claim is for 11182.07 being monies due from the defendant to the claimant in respect of a regulated loan agreement between the defendant and Britannica S.a.r.l - Arrow ( No 0024203418 ) and assigned to the Claiment on 28/02/2013, notice of which has been provided to the Defendant. The defendant has failed to make payment and a default notice with the agreement and default notice has been served pursuant to the Consumer Credit Act 1974. The Claimant claims the sum of 11182.07

              Stat Barred? Yes

              I have never received any knowledge of this debt, it came out of the blue, I did a credit check with Experium around 5/6 months ago and this is not on the report, I have a fair credit rating and a credit card from Nat west, I do not have any outstanding debts, I am retiring in two months to live on a state pension, I have no hidden assets. This has really caused me some sleepless nights, I hope you can give me some advice. Roger

                CCA request to Arrow asap to start. £ 1 statutory fee payable AG has 12 + 2 Working Days to comply. (template in the forum library.)
                Does this debt appear to be the Egg accounts as you have thought.

                      Hi Nibbler thanks for the reply, yes it was the standard Ni court claims letter, I filled in the defence on the response pack claiming that I feel it is Statute Barred debt, on there claim part Arrow quote the default was reassigned on 28/02/2013 and that I was notified this, that is an absolute lie, I never ever had any knowledge of any such transaction, I did an Experian check on 17/3/14 and there was nothing about this reassignment on the report.
                      I have now sent them the Template letter along with a £1 postal order asking for the CCA report, I did this all yesterday paying registered first class next day delivery, I also copied in the acting solicitor registered delivery and sent the claims form back the same way. I will keep you all posted, to be honest I am still trying to work out the system to use on this site, when you get to my age its a bit tricky, but I am learning. Thanks for the reply.

                        A notice of assignment can come from the original creditor and/or the debt purchaser.
                        Arrow Global bought the debt on 28/02 2013, an I think quite often AG do not report
                        to the CRA's until they commence collection action.
                        Have you checked a current credit report?

                          The debt being assigned to Arrow in 2013 has does not change anything to do with whether it is statute barred or not.

                          You should have received a notice of assignment, but even if one was sent they are often sent to an old address if that is all they had then. Whether you can add the lack of receiving that to any defence now I'll leave for other to comment on,

                            Yes, and they did (and may still do) have a nasty habit of changing or re-registering the default date from the original one to the date that they bought the account or similar.

                            So yes, checking credit reports now is very advisable.

                              Hi guys
                              I joined a couple of weeks back, I had a county court letter letter re a debt of 11K, which I was unaware of, I made contact with Legal beagles who gave me good sound advice, I recall posts from nemesis45 on 12/02/15 and others, I followed the advice and sent the statuary letter to Arrow asking to send send me details of the Credit agreement, I sent everything recorded delivery and also sent the court the same information, advising them that I had contacted Global for the agreement information, and I also sent the solicitor acting for Global the same details along with the standard £1 postal order for the details, I sent the postal order direct to the acting solicitors, as it was requested on the County court claim form to send any documents and payments to them, I did inform Global that I had sent the £1 payment to there solicitors, after sending the letters, the court confirmed receipt of my defence, I received a letter on Monday the 23/2/15 from Arrow global asking to confirm my address and confirm my address and details of employment and other confidential information, the letter was dated 19/2/25 I actually received it on 23/2/15 it was not recorded. I have had no response from the acting solicitors.
                              As I see it they have failed to send me the information that I have asked for within the 12 day period, I have no intention of sending them confidential details about myself about or about an alleged debt that I am unaware of, I would appreciate a bit of sound advice on this, I have sort of prepared a rough draft which I was going to send to them, their solicitors and the court, I hope you can give me a bit of guidance.
