    Is this date the default date OR the dale last delinquent (payment)?
    If no payment or written acknowledgment has been made in the 6 years from xx Jan 08 the debt is already statute barred.

      That is the last payment jan 2008 and feb late payment , march late payment then by april 2008 its red boxes saying default .

          Hello ,
          me again after putting my defence of statute barred and asking for a cca from Lowell and recieving no acknowledgment ... I now have a notice of proposed allocation to the small claims track , I've filled it in saying its statute barred and I've recieved no documents as requested by me from Lowell or Bryan Carter , I can't work out why they have pushed this through . Is it normal proceedure ?? PLEASE HELP

            seems to be , they are testing your knowledge out, see what happens next, & read other lowells etc threads and see the way they operate before probably discontinuing

                If you received the directions questionnaire that means they've decided to proceed. Have Lowell or Carter come up with any phantom payments or any arguments to say it's not SBd?

                    Sorry , I sent a request with the postal order recorded delivery and nothing has come back to me at all . I entered my defence and heard nothing until now .

                      Just had another letter saying they will accept half of the amount owing or they will continue to pursue it in the small claims , it's 100% statute barred . Do i carrying on defending . Still nothing proving I've paid anything

                          If they were so confident of getting a CCJ for the full amount, WHY would they offer a 50% discount? :noidea:

                          It it's 100% SBd, they'll get 0% in court, that's why! :grin: :grin: :grin:

                          I'd just ignore their 'generous offers' and do nothing for now, let's see if, after seeing you're not going to bite, they see sense (difficult with Lowell but it can happen) and decide to discontinue the claim. ray:
