    Hi,
    Things to do CPR31.4 request to Carter
    CCA request to Lowell (£1 statutory fee payable, use cheque PO endorsed " for statutory fee only". Lowell has 12 + 2 working days to comply.

    You say the debt is statute barred what basis do you have for this?

    SB England /Wales = 6 years no payment or unequivocal written acknowledgment of the debt.

    SB clock starts ticking (Simple contracts unsecured loans/credit cards) the date a contractual payment was due and not made after which no further payment or written acknowledgment was ever made.

    Can you please post up a copy of the Particulars of Claim, after removing your name/address and the claim number.

      Hello Nem,
      I have started two threads of the same ... have uploaded the claim form on my other thread... I will keep further post on the other one... do not know how to delete this one. just to complicate things....

          Acknowledge Claim - within 14 days from Service

          Defend Claim - within 28 days from Service (IF you acknowledged in time)

          If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
