  • Court Stay lifted?

Will the courts inform me that a stay on my case, has been lifted or not?

A stay should only be lifted on application, CPR23.4 says that you should be served notice of any application - so you should be able to respond to it - it can be decided with or without a hearing and you would be notified of the resulting order.

Just to clarify, I will be given warning that they have applied and I can send in a defence?
      Many thanks

Yes, you are able to get your representations in, but do so quickly even if the application notice doesn't specify a time limit - if you oppose it the court may well direct a hearing.
