Solicetors Letter received - Drydensfairfax

Hi All,

Back again, after successfully stopping Cabott and their solicitors in their track a few months ago, I have now receieved a seperate claim for a seperate debt, this time from Drydenfairfax representing Capquest. They are claiming in the letter that

1) They have received instruction to issue County court claim
2) Its not too late to stop the claim from being issued

Question is - do Drydens normally follow this through? If so I guess now is the time to hit them with request for information letters?

Any gudence would be appreciated

If instructed to continue by their client it's not Drydens decision.
I'd get a CCA request off to Crapquest now.

Do you know what the debt is?
What type of account is it?
Do you know the default date?

Right all, an update on this claim, and some advice needed i think

1) Received letter from Drydensfaifax stating 'Account on temporary hold while theire client deals with the query'
2) Received letter from CAPQUEST stating ' Lloyds banking group do not require customers to sign an agreement under the CCA for an overdraft facility...... therefore have returned my £1 PO..... A statement of the account has been requested from the originator and will be provided once received, The account is being dealt with by their solicitors so they request i contact them with any further queries.

hmmm - I assume i just wait for the 'Statement' to arrive at this stage? Any idea how this one might play out?

Have you actually received a CLAIM for this account? or just a letter from Dryensfairfax? I see nothing above that refers to an actual court claim, unless it's been posted on another thread. :noidea: :confused2:

If this was an overdraft, they are right to say the CCA request does not apply.

Have they actually taken you to court?

Ah good to hear!

There was repeated reference to CLAIMS on this thread and I just had to make sure, because if you receive a claim, you have only 14 days to acknowledge it. :clock:

I see you got a letter on Jan 30th From Drydens Fairfax and you responded with a CCA request as your post didn't specify this was a current account overdraft. If I've got it correctly, Drydens have written back saying the account is on hold and they've not written again. If they do, post up as soon as you can and we'll sort out a response. :typing:
