    Morning

    Hubby has received a claim form him vs bw legal on behalf of vodafone. This is the first we have heard about this being moved to anybody but apparently it was assigned to them in 2013 according to the form. I have filled in the AOS to get the extra time as I 90% believe this is statue barred. If it isn't then its very very close, and he will owe it as its one of our debts from a part of our life where we really struggled when losing his job, but anyway........

    Do i need to send a CCA and CPR to bw legal? And also i need to complete something for the court don't i, I cant remember which forms as I'm currently at work and not got them in front of me.

    Edited to add none of the 3 credit files have this debt from either vodafone or bw legal, not sure if that is relevant or not, I assumed all credit is listed on one of them?

    No on credit files usually means defaulted more than 6 years ago, if there has no payment or written acknowledgment in the 6 yaer period it will be statute barred.

      Ah right, there isn't anything on any of them my mistake i just assumed. Not had an contact with the company.

      Is my next step just to explain it in the defence part of the claim?

        Yes failure to comply with CCA should be on the defence.

          Oh no this isn't statue barred, I've just been on facebook looking for a photo from Blackpool thinking we went in 2008 and we didn't it was July 2009 and that's when he took his phone contract out. Best fill the other bit in now, thank you for your help though.

            It would be a good idea to check credit files before going on, check default date!

              Sorry for the delay in replying, its not listed on any of hubbys files by vodafone but iv'e found it under lowell

                  Based on the default date, it doesn't appear that this account would be classed as statute barred.

                  However, if your husband would like me to take a closer look at things, ask him to email me with his details via the Contact us form here and quote the code WRT135 - FAO Lee in the subject line.

                  Once sent, he'll receive an automated reply with a reference number. Post back with this and I'll check I've got it.
