  • Getting debtors attending court for questioning - N316

    Has anyone experience of using this successfully to obtain payments from debtors?

    I'm planning to use the N316 process whereby the debtor is ordered to attend court and answer questions about their finances and circumstances. Can they easily deceive the court officials - changing bank account prior to the hearing, lying about income etc?

    Also regarding serving the form (N39), could i get a courier/ parcel firm to deliver it to the debtor?. They will obviously obtain a signature - is this a satisfactory method of serving it?

    I would be foolish to lie under oath at an order for questioning hearing, not to attend is contempt of court and one can be arrested.
    Often such orders are delivered by couriers it is an accepted method of service.
