Court Claim - Cabot Financial ltd / Barclaycard - 19-12-2014

    Just looking through the paperwork for the claim no. and trying to write a letter . I just discovered a letter from mortimer clarke saying that they have been instructed to close their file in relation to this matter .
    they then also attached a notice of discontinuance of the court claim .
    So that means we have won that one and that i dont need to provide the court of cabott with my new address .... or do i ?
    the letter they sent in July says they are not going to persue the collection of the account unless the information is obtained
    then says dont take this as a write off and that the debt remains . it also says due to the time elapsed it will no longer appear on my credit file .

      So does this mean I dont need to tell them and the court of my new address do you think ?

        They have discontinued the claim so you don't need to deal with the court any more and if they were to issue a new claim it would constitute abuse of process unless they could show there's new evidence that wasn't available the first time round. Having said that, you just never know, the debt could be sold on and a claim could be issued at your last known address which you wouldn't know about and default judgment would be obtained when you fail to respond, you'd then have to apply for set aside arguing there had been a previous claim.... :blah: :blah: If they have your address there would be no need to worry about that eventuality. :thumb:

        Acknowledge Claim - within 14 days from Service

        Defend Claim - within 28 days from Service (IF you acknowledged in time)

        If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
