  • CCJ put on my credit file after bankruptcy

    hi everyone
    i declared myself bankrupt in nov 2008 then in may 09 a company im told told by northampton court howard cohen put a ccj order in for a debt of £217 which i dont know what is for but i thought declaring myself bankrupt in nov 08 would have wiped all this as all my other debts have been done and settled and my credit file is clean apart from this as it did not show on experian credit checker when i was looking at the mortgage in march this year but has shown up on another credit check service !!!
    i have heard that you can get these 'set aside' but dont know how to go about it,
    i have spent the last 6 years of my life getting it back on track after being silly with money years ago spending when i shouldnt of and then when i try and make things better for my family i find this on my file, nothing has been done with it since it was put on there in may 09.

    can anybody please help our mortgage guy has been really helpful and says he can help us but would like to try and get this sorted before we go any futher.

    any help would be most appreciated

    Lee, I think it is against forum rules to put personal email addresses in and the principle of this forum is that any advice given is given in the public forum. You might want to remove your email address.

    The first thing you need to do is contact the court at Northampton and ask for a copy of the order giving judgment.

    Others know more about bankruptcy and will be along soon I'm sure.

      Was this debt actually included in your BR, do you know specifically what liabilities were included.
      Howard Cohen (solicitor for rent to debt purchasers/DCA's would have been acting on behalf of one
      such company that acquired a debt from the original creditor.

        1st this will drop off your credit files in May 2015, even if you don't have it set aside or removed.

        So it's a toss up whether it is worth it. If they never try to enforce it, and you can wait for your mortgage app, then you might feel you can just wait until May.

        (to be honest not sure you would get it off your file much before then anyway, even if you tried)

        But if you want to try anyway, you need to find out from the court, or failing that the solicitors, who was the original creditor and what it was for.

        All pre bankruptcy provable liabilities/debts - with a few limited exceptions - would have been legally covered by your bankruptcy whether they were listed on your original paperwork or not. The court would not automatically pick up the bankruptcy in a CCJ unless it was defended on that basis, hence you can end up with a CCJ like this in some cases.

        For removal.

        - In some cases the court will help you get it removed with minimal hassle
        - In some cases the creditor will cooperate in doing that.
        - In others you may be forced to formally have it set aside.

        Depends on how much the court staff and creditor are prepared to be helpful and cooperate, and both vary massively.
