    I filed a generic defence to Wright Hassell based on failure to comply with CPR 31.14, & Consumer Credit Agreement as is my entitlement under sections 77-79 of the Consumer Credit Act 1974.

    The court has ordered Wright Hassell / Cabot to file a reply in 28 days or the action will be stayed. Court permission required to continue.
    No easy default judgment !

    The clock is now ticking on Wright Hassle & Cabot.
    No documents supplied.

      I hope so, they didnt provide a start date on the court papers so i've checked my credit file and i the one it refers to has a start date of 2002. Hopefully they will have lost it!

      I just want to check are you saying i should include this line in my email to them?

      I've already sent the email in my post above but i think it is a clear request to them. I doubt they will send an email over the weekend so i'll file my defence on the basis i have not had the documents i requested and cross my fingers. When i finish up writing my defence it would be great if someone could give it the once over.

        I have gone down the routes on this. The last thing I got was a letter from Cabot's solicitors saying due to protracted legal fees to avoid further action they would accept payment of 50% of disputed claim. This was made after the court gave them 2 months to get information to them which they couldn't do the court gave them a further 1 month extension to get information but only gave them 1 which has gone. I did not reply to this later and the time given has passed. Today they rang me I only know it was them by 1471 the phone no and looking it up they phoned saying they had something important to discuss and asked me questions to satisfy data protection. I indicated unless I knew who I was talking to and what it was about I would not answer questions and put phone down. How do I make sure they do not take manipulate the situation. They are chasing me for payment on a loan with Lloyds when I have never banked with Lloyds have been banking with the Coop only for years on a loan sold on to them which they have no paperwork for. I have a husband with a severe heart condition who has jsut had a heart op and needs more surgery and both of us are not working him due to ill health and me redundancy and this is all very worrying as over substantial amounts which could make us homeless.

          The last time i called the courts they said the claim had been stayed. I've had no letters or calls from Cabots since. It seems we are in a similiar situation as i've never had a Goldfish card so i've no idea what they are on about. The problem is it is on my credit file as a default but it expires feb 2016 so probably explains why they are chasing me.

          If they havent provided the info to the courts then i'm sure their claim on yours will have been stayed too.

            If you have never banked with Lloyds and can prove it, perhaps
            it would be a good a idea to make a Formal Complaint to Cabot
            straight to their CEO Ken Stannard regarding his company's conduc
            regarding this claim.

            I'll help with draft if needed.
