Re: Lowell/Carter Tomlin Order please help!
A Tomlin Order is just a document that stays the proceedings as long as you keep to the terms of the order. Basically you agree a monthly installment you can afford and avoid a CCJ. It is important to make sure you can maintain the payments in the long term, because it can be very difficult to vary the terms of the order, but it's a good way of avoiding a CCJ. :thumb:Originally posted by Charlotte_starlet View Postwhat the hell do I do now! Re: Lowell/Carter Tomlin Order please help!
You must demand unequivocal proof of the alleged payment.
How it was made, cheque, postal order, debit card.
Account a cheque was drawn on, name of account holder, bank name and sort code.
PO number, issuing office , payee.
Debit card 16 digit number, 3 digit security code, expiry date, issuing bank.
State that without unequivocal proof the payment is denied.
Did you make a CCA request that was unfulfilled?

Originally posted by FlamingParrot View PostIf I read the below correctly, the OP has stated that they found the £1 payment in their OWN statements.
Unfortunately I have found a £1 payment but not on the date they said I paid £1 - completely different month!
im not sure what to do now, I'm thinking I should just go ahead with the defense, based on the fact they have stated 11/2/10 was the date in their letter today to me and I have my statements to prove I didn't pay then. I am going to stay quiet about my findings today and hope to god they have made a huge error!
Or do I agree to the Tomlin?
thanks for your answers, it's so comforting to find good advice

A Tomlin could be a useful way to avoid a CCJ if it comes to that, as it doesn't appear on the record.Originally posted by Charlotte_starlet View PostOr do I agree to the Tomlin?Last edited by FlamingParrot; 9th December 2014, 13:49:PM.

They never have much of a clue. :grin:Originally posted by Charlotte_starlet View Posti read on another forum that they may offer a Tomlin in a last ditch attempt, do you think that could be true here, they seem to have no idea on the phone what is going on!
The Tomlin Order works both ways, because it stops you from getting a CCJ that would show up not only on your credit files (which not everyone can access) but also on the public record (which is accessible to anyone upon payment of a small fee), for six years. The Tomlin Order does not appear on the record. :thumb:Last edited by FlamingParrot; 9th December 2014, 14:15:PM.
