A Tomlin Order is just a document that stays the proceedings as long as you keep to the terms of the order. Basically you agree a monthly installment you can afford and avoid a CCJ. It is important to make sure you can maintain the payments in the long term, because it can be very difficult to vary the terms of the order, but it's a good way of avoiding a CCJ. :thumb:

Make sure you get them to prove a £1.00 payment, no doubt phantom payment there proof of how paid by whom and How with evidence.

You must demand unequivocal proof of the alleged payment.
How it was made, cheque, postal order, debit card.

Account a cheque was drawn on, name of account holder, bank name and sort code.
PO number, issuing office , payee.
Debit card 16 digit number, 3 digit security code, expiry date, issuing bank.
State that without unequivocal proof the payment is denied.

Did you make a CCA request that was unfulfilled?

Unfortunately I have found a £1 payment but not on the date they said I paid £1 - completely different month!

im not sure what to do now, I'm thinking I should just go ahead with the defense, based on the fact they have stated 11/2/10 was the date in their letter today to me and I have my statements to prove I didn't pay then. I am going to stay quiet about my findings today and hope to god they have made a huge error!

Or do I agree to the Tomlin?

thanks for your answers, it's so comforting to find good advice

A Tomlin could be a useful way to avoid a CCJ if it comes to that, as it doesn't appear on the record.

They never have much of a clue.

The Tomlin Order works both ways, because it stops you from getting a CCJ that would show up not only on your credit files (which not everyone can access) but also on the public record (which is accessible to anyone upon payment of a small fee), for six years. The Tomlin Order does not appear on the record. :thumb:

Phew! I've spent ages trying to figure out how to delete, I have visions of Bryan Carter in a MI5 type mission to track me down through the internet! That would be brilliant! Thanks again, you're a superstar!
