Re: Lowell/Carter CCJ. Barred Stature. Fictitious payments.

Sandy Ago.... am getting scared now as I had relied on other matters ... like the fact it was not on my credit report (going off things on other sites stating if a payment was made after the default date it "resets the clock" so the 6 year limitation period starts again"). seemingly i have found today that is untrue. So my only hope is them struggling to prove this alleged £1. I KNOW I would NOT have waited 3 years after default to pay a one-off £1 then pay nothing more for 5 years! Money may have been tight for many years, but anyone could struggle to pay a £1 a week or fortnight or month ! I have never had a bank account.. just a building society account. Any payments I have had to make has been cash at the post office with a payment slip/card whereby you get a receipt. The only £1 payment I have ever made has been for CCA requests- via postal order. 5 months on and BC/Lowell have failed to give proof of this alleged £1. I am just praying the judge believes my truth not their fictitious payment. This matter has wasted 8 months of my life and got me ill to the point i can't eat, sleep and has my nerves shot to point I am having severe panic attacks. My life has been so stressful personal wise with people close to me dying , gravely ill etc.. as well as severe issues affecting my children (bullying to the point my son at 12 wished he was dead, fighting to move him school) as well as numerous other factors. This has been the straw that broke camel's back but thanks to lovely people on here helping and others in same boat supporting one another its just about keeping me sane! good luck to you too hun xx

debs65... I know how you feel hun. Yes, there are wonderful people, support and well wishers here yet I'm sure you still feel you're facing this quite alone at times, especially as it's probably not something easily discussed with family and friends. Remember that statute barred is an absolute defence and they have to prove not only that a payment was made but that you made that payment. Even if that could be proved, the judge is going to recognise that a £1 payment is far more likely to be for a search fee rather than any instalment towards a debt... especially as it was (allegedly) made some 3 years after any previous payment and then nothing more for 5 years! If it was a genuine payment it would be followed up, and chased up, with others to make, perhaps, a temporary arrangement eg £1 per week, month etc. Also, if they were confident that they could prove it, they would have provided you with full details by now. I suspect that Lowells may be getting their excuses lined up by being able to claim some kind of "administrative error" as it was someone else who told them the payment had been made! wishing you well x

Aww. Thanks for all you have said Sandy Ago. You have made me feel so much better! I found a bit of fight in me earlier and I decided regardless what they pull out bag I am going to court to plead my case- not just for me but for all who have been affected by these fictitious payments. Yes I feel alone and absolutely terrified but they have made my life hell 8 months- I can't give up and let them get away with it without one last fight. Thanks Hun for your support xxx
