      Definitely agree, it's expected the parties will attempt to resolve the matter without a hearing saving time and costs.

          So my argument with them , should be that they need to prove the debt and prove its not statued barred ,

            The onus of proof that the debt is not statute barred falls entirely upon Lowell.

              Today I recieved a letter from Brian Carter , it was a copy of the claimants direction questionnaire , it also states the claimant is willing to settle outside of court and they look foreward to hearing from me regarding negotiations ,

                  Received a phone call from the mediators today unfortunately I missed there call but they left a message to arrange an appointment , I will arrange appointment on Monday ,

                  Acknowledge Claim - within 14 days from Service

                  Defend Claim - within 28 days from Service (IF you acknowledged in time)

                  If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
