  • County Court Claim owe HBOS

    I got a Country Court Business Centre claim form in the post

    details as follows

    Claimant Arrow Global Ltd

    Drydensfairfax Solicitors

    Defendent myself

    From the claim form I owe HBOS which I dont ever recall owning them anything

    Whats next action

    acknowledge the claim but defend it and ask for proof of this claim

    All help much appreciated

    just to clarify

    I need to do the following

    1: ACKNOWLEDGE THE CLAIM - you can do this online usually at www.moneyclaim.gov.uk
    You'll need your claim reference and password from the front of the claim form

    2: Send A CCA REQUEST to the CLAIMANT ( see here )
    This applies to all credit cards / loans / hire purchase / store cards type debt. It doesn't apply to Mobile Phones / Utilities or Overdrafts.


    3: Send a CPR request to the CLAIMANT'S SOLICITORS ( see here )

    This applies to everything unless they happen to have supplied you with a bunch of paperwork to back up their claim (v. unlikely)

    And once I get response on the documents I requested, I can then defend my claim

    As mentioned in another post, the County Court claim was not signed by a human but just the name of the solicitors that looks like its been printed via a laser printer.

      once I acknowledge reciept of the country court letter and want to defend how long do I have to put my defence in.

      The CC letter is dated 6th November but I got it 11th Nov .. I would appreciate the timeframes I have to work to.

        Acknowledge Claim - within 14 days from Service

        Defend Claim - within 28 days from Service (IF you acknowledged in time)

        If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
