    Particulars of Claim:
    By an agreement between egg banking plc (egg) on or around 10 mar 2006.
    (the agreement) egg agreed to issue the defendant a credit card upon the terms & conditions set out therein. In breach of the agreement the defendant failed to make the minimum payments due & the agreement was terminated. The agreement was assigned to the claimant on 31/01/2013. The claimant therefore claims:
    1. 4752.82
    2. Interest pursuant to section69 of the county court acts 1984, namely 2500.63 & continuing until judgment or sooner payment at the rate of 1.04.

    Have sent: Acknowledged the Claim, Sent a CCA request, Sent a CPR 31.14 request

    I have done the ccaand cpr letters not sent them yet do they need to go recorded or registered?

      Hello and welcome

      Any formal letter to a bank/DCA/Solicitor should be sent 'signed for' which is the new terminology for recorded. Costs just over £1 I think for a letter. This is so that you can check and store proof of delivery.

      You seem to have this in hand now and there have been a number of Egg/Marlin claims very recently from a batch bought from Egg. If you look at the Received a Court Claim? you will see other cases to study.

          At what point do I need to contact these people to chase paperwork ask for extension etc ie what is next step and when?

            Hi all cca and cpr received by recipients on 3 oct , issue date of claim was 25 sep so believe defence date by 28 oct. Is there anything I need to do now or is it a waiting game ie when do I contact them? Dont want to get a ccj due to my ignorance. Many thanks for all the valuable help and advice as I wouldnt have a clue without this forum. Thanks again

                I have received a reply from mortimer clarke today stating they are taking their clients instructions and will come back to me as soon as possible. They have agreed to an extension of 28 days (exactly the same letter as hairbear). I will write to court to inform them, is there a template to use for this please? Thanks for all the help so far.

                  Two years ago I asked these clowns to substantiate their claim. Still waiting. They bought a shed load of old egg debts without paperwork

                    It seem there are a few of us at the moment dealing with Mortimer Clarke, I just received the same letter as yourself. I found this template to send notification to court for extension of time to file defence http://www.legalbeagles.info/forums/...filing-defence. Im not sure if it can be emailed but recorded written letter might be best.

                      I have sent the letter posted in footballgirl post to the court. Is it just a question of waiting now? New date for filing defence is 25th Nov 14 so will put in diary.

                            Hi all just received a letter back from marlin which reads:
                            We write with reference to the above matter and confirm receipt of your letterand postal order for £1.00.
                            However the postal order has not been completed with the payee details, please amend the payee to mortimer clarke solicitors and direct all correspondence regarding this account to them in the future.

                            I left the payee details blank so it could be cashed by any of them, is the another ploy to stall me? Do they have a legal obligation to deal with it? I know they are just trying to mess me about as their solicitors are in the same building ie in house solicitors. What would be my next course of action please help.

                              I have just read your thread and we are in the exact same position. I too recevied a claim on 25th Sep from Mortimer Clarke for Marlin for an Egg card and for a similar amount to you. I sent the CCA and CPR requests off to Marlin and Mortimer as per the advice I have got on here and I have got back the response today from Marlin that they dont have the CCA and are requesting it from the original creditor. They have referred me to Mortimer for all future dealings with this too and Mortimer have also written to me saying they are prepared to give me a 28 day exntsion to file defence. I will use the template in this thread for response to court to advise them of the extension and will also check your thread for advice as my new defence date is same as yours - 28th Nov. Amethyst and Kafka have been supporting me with advice to date which has neen invaluable. Hope this is resolved for both of us.
