    So, Today's convo with RBS, They didn't call us we called them) The lady had looked into the account & could see where this started, Multiple mistaken charges along with refunds,< Her words) A second complaint is being made to the 'Extreme complaints department' We will be notified in writing within 5 working days. In the meantime we have sent for all account activities just like you said. She also went on to state that it was Newman who sold the debt to moorcroft so that is nothing to do with them however, We have spoken to moorcroft and they have been quite helpful & have froze it until this is over. Im feelin very optimistic about this especially after she said she's looked through and can see herself it started as a bank charge error, She just couldn't figure out how it progressed, She seemed honest & helpful! So I guess it's a matter of wait & see!

      Hmm just spoken to my husband, Can i correct she seemed honest & helpful until he confirmed he'd like to raise a compliant, Then she went a little sour! :-@

        She might have just realised that something was hitting the fan .

          If you ring them again ask if the call is being recorded . If it is ask for a copy of the recording or a transcript . If it isn't then record it yourself just let them know. So ask if if is and they say yes say "likewise" now they have been informed that you are recording the call . Do you possibly have copies of any of the old complaints ,? If so they can be submitted t the ombudsman when the scenario reaches that stage.

            Update : Okay so we've just recieved a letter from RBS which goes like this,
            Thank you for your recent call requesting a copy of your loan agreement. Investigators have been sent to your branch and have stated they were unable to locate the paperwork. I have also searched our systems and I am unable to locate the document.

            Moving forward, I can only apologise for the fact the Bank is unable to provide a copy of the loan Agreement. Our records do confirm that you did have use of the loan funds & therefore the loan is valid. I have attached a copy of your transaction history for account ending ****, Which shows the funds for the above loan account crediting your current account.

            Ha! Honestly tickled me that letter. So they cant find any loan agreement? YES! Because NO loan was EVER agreed! It was bloody bank charges they bullied us into paying back through solicitors & DCA. Any advice in how to respond? Cheers.

              The transaction history statement shows a balance of £739.24.
              To which is what we apparently agreed for a loan, BS

                    Did you ever, according to their transaction history, have this loan prior to the opening of another bank account?
                    Furthermore, can they supply statements on the account where the money went to, so as to show how the money was actually spent?
