  • MKDP LLPCourt claim

    Hi all,
just received court claim, they provided a reconstituted copy of my agreement with old and new t and cs, would it be possible to offer to pay certain amount on monthly basis because it does say if admitting all debt "entering an admission may mean a judgement being entered against you" what does this mean?
I had my fingers burnt by the last DCA £10,000 times and cant let that happen again, im running scared

Can you provide a full background to this with a timeline?

How did you manage to get hold of the copy agreement?

      Many thanks for prompt reply
      Hi
It all started 12/12 cc of HSBC when moorcroft contacted me i went down the CCA route and they passed it on to metropolitan who passed it onto Sigma, then capquest then albion then akinika and finally SOLD to MKDP

They have been writing since7/13 not being able to provide documents asked for
on 25/5/14 i received a wad of paper in it-an HSBC credit agreement with my name written in it and my address, no date signature etc ( i thought this was classed as reconstituted)

A pile of original t & cs and new t &cs and statements at my new address from the date i started being unable to pay and a random statement for march 2014
Today i received a county court business centre claim form, i have 6 days left to return it
      Hope this helps

You still haven't said when this agreement was started. This is crucial because that determines whether challenging the validity of the agreement can be done or not.

What was the default process and was it followed properly?

What charges have been added to the account?

What was the assignment process to MKPD?

I really cant remember when the agreement was started on a letter 9/2012 from metropolitan they state it was more than 6 yrs ago so cant produce details requested,

I received a letter from HSBC saying sold debt to MKDP 25/6/13 a "copy" of the letter from MKDP adressd to me but dear someone else, lots of letters they cant provide details requested yet, then on 5/14 statements of old and reconstituted agreement

          No charges have been added

Assignment was a letter from HSBC telling me they sold it to MKDP and a letter of the same from MKDP
          Hope this is ok
