  • help needed re the Halifax bank and. Dryden's fair fax

    Help needed please
In 2007 I had a charging order placed on my home for a joint matrimonial debt
The debt occurred when I was married to my husband
We separated and both bought new homes
    The debt was from 1994.
The Halifax only pursed myself and I ended up taking legal advise and started to pursue my ex husdnad for helpnwith the debt
My soloitors had to go for ancillary relief as my ex husband would not negotiate.Dryden's were made aware of all actions
Whilst waiting to get in to court with my ex husband Snell and Booth solicitors took a 3000 settlement from ex husband this was in 2008:this clearly predujdist by case for ancillary relief
I have written documentation stating that his half of the debt was settled.
My solicitors offered 3000 to settle my half of the
Debt. They never responded to my offer.
In 2009 I had my home repossessed as I had funded my own legal fees for the and ancillary relief case.
The full debt was still on the house and did not take of the half of debt settled by my ex husband
After my home was repossessed Dryden's then went for an attachment of earnings I had to go bankrupt again the charging order was for the full debt
I feel I was unfairly treated as my ex husband earned more money than me he had his own home
I also had our son living me
I decided to complain to the halifax who have now stated they never had the 3000 from ex husband/ they never had an offer offer from solicitor to settlement from solicitor for 3000
The Halifax have stated that they received no paper work from my solicitor and they have now judged my file.
I have copies of all the letters and offers made to Dryden's

Snell and Booth solicitors took a 3000.00 settlement
Have you got proof of this settlement?
Do you have proof it was settlement for your Ex-Husband's part of the debt?
Do you have proof that Snell and Booth actually paid £3000.00 to the Halifax?
It could be that the £3000.00 was his solicitor's fees.
Or it could be that the Halifax turned down the offer and fees were returned to your ex.
Can you contact Snell and Booth and ask for clarification on what happened to the £3000.00?
Can you also contact your own solicitor and ask for proof that your offer of £3000.00 was made to Halifax?
It seems rather strange that the Halifax are saying that they never received any payment from your ex-Husband's solicitor, or any paperwork from your own solicitor.
You need to clarify this before anyone on LB can advise you correctly.

Thankyou for being kind and offering help
I have a proof from Snell and booth stating that the 3000 was taken as settlement for my husband s half of the debt and the letter states that the Halifax had confirmed receipt of the money and my husband would no longer be pursued the letter stated his half of the debt 22000 was settled

If this amount had been taken of the charging order or my three thousand taken I may not have lost my home
I have requested the solicitor s whonacted for me give me copies of all letters sent to Dryden's but they have refused as I owed them money before going bankrupt

Would a SAR request (costs £10) be worthwhile here?? The solicitors would HAVE to provide the information then, wouldn't they??
