    Could I settle the claim and then try to sue for the charges? Or would this need to be done by counter claim?

      That might be possible, but it would be easier to get the data and counterclaim providing it comes before the deadline for filing the defence, which is likely to be delayed anyway as they won't have the documents.

      I once reclaimed charges from the original creditor years after a DCA had obtained a Charging Order, before I knew how to fight them. I did win back charges from the OC even though they no longer owned it, but it did mean fighting a solicitor in court. I don't recall any other instances where anyone has reclaimed charges from an OC after the account has been sold and secured with a CCJ.

        So far your help has been invaluable, and saved me making a massive mistake I think that I will be needing to peruse the defence of not being certain as to Which act is governing the account due to how close it is to the time the law changed and the date they claim it was opened could be a mistake, Do you think that wis will stand in court or is it a long shot?

          Most of your actions will be dictated by what they send you when they disclose the documents and you have to play the hand you are dealt. There may be different options to call, but really this is just speculation until we can see more of the data. As long as all the letters are gone its just a waiting game until the 28 days is ending and you need to seek a 28-day extension if it looks like they won't deliver the documentation in time. In the meantime the best thing to do is keep reading up and looking at the different ways these claims can go. No use worrying until we know there's something to worry about! :tea:
