    hi i can log in but when i type the claim number and password it comes up claim not found??

      Hi Turtle,

      Right, the last date for Defence is very close now, so in addition to calling the court re the login situation (as advised by Jon above) you need to get on to the Claimant and get them to agree to an extension to file your Defence.

      Dont accept "it's on hold, dont worry" as this can quite often be a trick for them to go for Default judgment - you need an email clearly agreeing to extend the time to log a Defence by 28 days that you can then send to the court.

      You cannot be expected to file a reasonable defence without them showing all detail.

          Hi,

          I would advise calling rather than emailing - they are likely to be slow to respond to email as this could be in their interest

          You are asking the solicitor to agree to a 28 day extension under CPR 15.5

          You need to be firm with them and ask why they have not yet responded when the CPR request required a response within 7 days of its service upon them and they are now in excess of 14 days from the date they signed for it.

            Another thing to add is that I am aware that many on here don't agree with my position on this, but I always ask for a copy of the deed of assignment - without this proof that the debt was actually assigned to them in the correct legal manner, they have no lawful claim.

            Note this is different to the Notice of Assignment that is served upon you to tell you they now own the debt, the Deed of Assignment is the actual sale documents between Wonga and Lowell

            When I asked for it, they kept bleating on that it was a confidential document, but this was easily circumvented by stating i was happy for the price the debt was purchased for to be blanked/redacted from the copy they provided - in my case they are still arguing confidentiality despite this and I feel if it goes to court this will sit badly with the judge.
