  • Welcome Finance/IND in Court

I am being taken to Court over an old debt I had with Welcome Finance.

I do not think it is Statue Barred, but basically I didn't hear from Welcome for a few years, even after I recieved over £3,000 in mis-selling of PPI, then I recieved claims from IND for the outstanding loan. I said, in my opinion, that the loan was repaid, as they should of taken the £3,000 to repay any monies owed to them, like other creditors. I have also recieved an incorrect 'Notice of Arrears' from them, making my loan larger when it was a credit!

I did write to them requesting a written copy of the credit agreement, which they agree they recieved, and that they replied to, but they did not send it within the time allowed, and do not state the date they recieved it, but I do not have a evidence to confirm this.

They have put their evidence to the Court within the time frame, do I have send in my defence (as the time frame has gone), and is it worth sending the court my full defence?

    Any advice/help?
