  • Drydens Fairfax/Citicard/Capquest

    Can someone help me please? Out of the blue I recently received a letter (dated 12 March) from Drydens Fairfax saying I owe CapQuest £3143.57. This apparently is because I made a credit agreement with Citigroup and failed to pay it. The debt was then sold to Capquest. I did have a Citicard prior to 2007, and I think I paid it off a very long time ago (also prior to 2007) but have no documentation. As I thought the letter was an error I ignored it, but today I have received a Northampton County Court Claim Form showing Capquest as the claimant, Drydens Fairfax as the address, and I have 14 days (from 28 March???) to repond to the claim.

    Until I received this letter I have had no dealings with any of these 3 companies whatsoever. I have checked my Equifax credit report and there is no mention of the above debt, no any record of any searches by the above companies (I have moved house 3 times since 2007).

    I really don't know what to do here.

    Hi,

    Don't panic - you've found LB and we will all do our best to help you

    Firstly, you need to respond to the claim

    By responding (you acknowledge the claim online using the password shown on the documents) and selecting "I intend to Defend all the claim" this gives you a further 14 days, so a total of 28 days + 5 to allow for service of the claim to you

      You state you have had no dealings with any of them, so I take it you mean this is not your debt in any way?

        Are you able to post a scan of the claim form, with any personal details removed?

        (we are mainly looking for the exact wording of the claim against you)

            I did have a Citicard (prior to 2007), and there could be a small balance outstandiing - absolutely nowhere near £3143 though

                OK, so you need to get them to quantify the balance when sending documents as well then

                When did you last make a payment on the card?

                  Hi,

                  you need to get that down quickly and remove things like :

                  Account number
                  Password

                  from the scan and repost it!

                  Remove ALL data that marks it to you (barcodes, amounts, etc)

                    Paid it last prior to 2007. What do you mean by quanitify the balance (sorry I'm being a bit thick)

                      OK, looked through it

                      1) Did you receive the Default notice they reference?

                      2) Did you receive a letter of assignment?

                      Have you moved since you took out the Citi card/last had contact with them?

                        As said in the first posts, you need to acknowledge this claim online stating an intention to defend it, this will give you extra time to get things together

                            In addition, you need to send a CPR 31.14 request for further information, you can find info on how to go about this in THIS thread.

                            If you use the template in that thread and construct a CPR 31.14 to suit your own requirements, you can then post you intended letter (minus all personal details!) on here for us to give any required advice on before sending it out

                            You need to send it to Drysden Fairfax (the solicitors) not Capquest

                            It's important that you make the acknowledgmen online as soon as possible, and once we have helped you check it over, get the CPR 31.14 request of to them ASAP as well.

                            Essentially, they have issued online because this relieves them of the obligation to produce documentary evidence of the claim with the claim form (if they were issuing at a standard county court, they would need to attach the documents they refer to with the particulars of claim).

                            But by sending a CPR 31.14 request, you force them into a position where they are required to send you all the evidence prior to any hearing.

                            If they then fail to provide this within 7 days of receipt of your request, you can make an application to the court for an unless order (this is also detailed on the thread linked above) which then puts them on notice from the court to supply the docs or have their claim struck out.

                              I've never had to do that, I'll see if someone else can help, but first try via the 'edit post' link that should be on bottom of the post, around the middle with a small pen icon by it
