    I'm not sure what celestine did, i haven't heard anything since she put it. Its Lowell that have actually taken it to court, Ive not heard/had replies from them either when information was requested.

      OK,

      But you've sent both a S77 CCA request and a CPR 31 request to them for info, yes?

        If it's yes to the above, you have 2 choices:

        1) Call BW and ask them to consent to a Tomlin order where they discontinue the claim with each side to bear its own costs

        2) Make an application to the court via a N2444 that the claim be struck out on the basis they have failed to respond to the S77 request (and therefore cannot pursue whilst the request is outstanding) and your belief that the debt is statute barred (you can also request that the court order them to pay your costs to date, to be assessed if not agreed)

          I did as Amethyst told me on page one, and they were sent recorded delivery and neither have responded to them. I've kept everything i've done.

          N2444 form where do i get one from?
