CCJ claim form receiver - help greatly appreciated...

  • CCJ claim form receiver - help greatly appreciated...

    Hi.

    Received a claim for just under 2k.

    Relates to an unsecured debt from a few years back.

    Im confused regarding some things i need to fill in on the form.
    Do i include my partners income and debts etc?

    Ive seen this formula:

    Amount owed to creditor X Your monthly surplus income
    ----------------------------------------------------- = Payment offer per month.
    Total amount of debt you owe


    Is this how the payments will be worked out.

    What is classed as 'total amount of debt you owe'? - is this mine AND my partners?

    Can i list items such as mobile phone bills and a Sky package in expenses, these are things that i pay for monthly.

    Help with all this would be fantastic - thanks in advance :tinysmile_hmm_t2:

      Address for docs etc is BW Legal.

      Its a county court claim form.

              Ok, the form i have received is a ccj claim form.
              Its the one where i have to return whether i contest it, pay it or ask to pay in instalments.

              As i need to pay in instalments, i really need you guys to help me with the questions in my first post.

                What are the Particulars of Claim,who do they say you owe the money too.

                  The claimants claim is for the sum of 1742.26 being monies due from the defendant to the claimant under an unsecured loan agreement regulated by the cca1974 between the defendant and everyday lending ltd under acc no. ********** and assigned to the claimant on 31/05/2013 notice of which has been given to the defendant.
                  The defendant failed to maintain the contractual payment under the terms of the agreement and a default notice has been served and not complied with.
                  The claim also includes statutory interest persuant to section 69 of the cca1984 at a rate of 8% per annum (daily rate 0.33) from the date of the assignment to the agreement date of the issue (23/01/2014) being an amount of 78.54

                      Hi, ye i do owe it, it was taken out about 5 years ago.

                      I obviously need to pay this but am concerned they may make me pay hundreds per month.

                        When did you last make a payment for the debt,and what country do you live in.Are you working.

                          Last payment was around 3 years ago, im working in england.
                          I have 3 kids 9 and under, my partner works pt earns around 600 pm, i earn 1500 pm. (both net)
