(By way of illustration of the risks you face, I dealt with a matter where the claimant was completely intransigent and insisted on taking the matter to court, it was a data protection issue, the trial went on for two days, the claimant lost and ended up having to pay £80k costs.

The claimant is always at a higher risk of being saddled with huge co$t$. In Santander v Mayhew, they awarded around £50k worth of co$t$ against Santander! :bounce: :bounce:

I mention this not to try to scare you but simply to illustrate how quickly costs mount up when there is a trial.

Almost half the amount is costs! :rant: :rant: :rant: If this claim had been issued a few weeks later, it would have been allocated to small claims, they were just unlucky.

I was planning to send a letter to Shoosmith in the past few days but life's (kids & work) got in the way so didn't get to send it. I have now drafted an e-mail which I am going to send to a Mr Foley tomorrow and am wondering if you guys can advise me or give opinion if its good enough to send.



As I am suppose to respond to them by 4pm 20th January, would this respond suffice? What do you all think?

I decided that I don't want to go through another fast track court case so I settle outside court last year. I am still waiting for them to give me bank details so I can start paying but shoo smith never send me anything so yet to pay. Suddenly a couple of days ago I received letter from court & they have applied to court to change claimant..
