    I pulled onto a car park in the Windermere area of Cumbria, the car park had one pay and display machine, I tried to make payment via this machine three times but the machine was not responding to any input I made. I noted the tel number on the notice board nearby and called the company to inform them of the faulty unit, how ever the system is fully automated and does not give the option of speaking with an operator, one option does however state the machine are closely monitored and if faulty no parking charge would be made. I left the car park within 15 mins of arrival.
    i made contact with parking eye by telephone some days later and told them of the issue on their site, and was told that as I had left the site without paying I would be liable for a charge. I pointed out that I had attempted to make payment but was unable to do so because of their faulty equipment.

    Am I liable for the penalty charge they claim?

    Even had you parked knowingly with no intention of paying i'd say no.

    Have you had a notice or ticket yet ?

    Whatever you do get a recording of that message that says no charge ! It might not be vital but by christ it's a killer if you have it.

      Not had notice yet, will get recording from their system, I was not truly convinced when I heard the message that's why I made contact with PE later.
