      court action puts a hold on the statute of limitations, so its not statute barred

              Dont agree anything with the claiment. They are only making the offer to you as they know you will be granted the set aside anyway which will restart the court proceedings and leave them open to you questioning why their claim was only for an installment of the debt and not the full amount, which will likely mean they will discontinue anyway!!

                      bryan carter is a solicitor for rent who debt collection agencies use as he has a dubious reputation for sailing close to the wind

                      when you have a claim form, his details are normally on the court form who you have to contact to talk about the debt

                      a debt agency use him also to threaten legal action

                      I yesterday received a letter from there solicitors and it goes like this

                      without prejudice save as to costs

                      thats post 9

                              Goto court, get the setaside, as i gaurantee they will discontinue any claim given they will have to answer to a judge as to why they abused and mislead the court, regarding claiming for installment and not the full amount of the debt! And they will not under any circumstances risk having to do that!

                                i hate it when the likes of carter allways try for a judgement by default

                                he can put anything he likes on the claim form, as soon as the poc is questioned, he withdraws

                                Acknowledge Claim - within 14 days from Service

                                Defend Claim - within 28 days from Service (IF you acknowledged in time)

                                If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
