    Hi Everyone,

    I am posting with urgent need, hope someone can help me. I have a county court claim issued to me on 2nd may 2012. The claim is regarding debt for £1880 which is based on a current account overdraft which I had with Lloyds in 2006 since then it has been moving from 1 dca to another. Lot of the amount is made up of charges which they added on after I defaulted and was in financial hardship. The present dca Hillesden Securities applied for CCJ very quickly before I could respond. I am confused in how to approach this.

      Make sure you send in an Acknowedgement of Service, then you have another 14 days to prepare your defence.
      .
      If you indicate that you want to defend the cliam, that buys you further time, during wihc you can write to them re unfair charges etc and dispute the amount, with a view to possibly settling out of court and/or paying by manageable installments. If they have harrassed you - any breach of the OFT guidelines may well count as harrasment - counterclaim for this.

      If you want to refer the case to the OFT - apply for the case to be stayed pending ADR

      Acknowledge Claim - within 14 days from Service

      Defend Claim - within 28 days from Service (IF you acknowledged in time)

      If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
