  • Stayed Claims

    I am currently defending credit card related claims from both Hillisden Securities/Aplins and Arrow Global/Shoesmiths.

    Both claims were stayed before the end of last year after I filed my defences and the claimants failed to proceed.

    Does anyone have any advice on how to proceed with these cases - should I just wait for the claimants to act or is there a way that I can take the initiative?

    I have the same with link financial claim was stayed last year (may) now it's head again and I am due to be at court on tuesday, I have a feeling they will either send a notice of discontinuance or not show up at court. But I am a little concerned at what I should do, do I go to court, if I do go I do not know how much the claim is for as this is not on the court forms and after the cca was sent all I got back from mba was a nice letter saying we have complied an application form and a copy of a card statement showing a payment of £24.99 and an outstanding balance of zero, amount owed balance zero.... So do I go and then say to the judge i don't know why I am here, I don't know how much the alleged claim is for, the claimant failed to provide docs after CPR and the case was stayed they still haven't provided any proof this debit is mine, so how can I defend something I know nothing about?

    Acknowledge Claim - within 14 days from Service

    Defend Claim - within 28 days from Service (IF you acknowledged in time)

    If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
