    Hi Folks this is my first ever post i have been fighting Northumbrian Water for 5 years and today it was resolved by a customer care assistant within 5 minutes after all my letters where ignored. I had been taken to court twice in Nottingham i live in Middlesbrough the water company was expecting me to pay £1,400p for unpaid water bills i wrote and told the company in 2005 that i had not lived at the billing address for eleven years but they ignored me and i had a CCJ placed on my property. Today i phoned the company as they said they would apply to Middlesbrough courts to place a charge on my property i spoke to a customer care assisstant who listened to me then phoned me back 5 minutes later and told me she had checked the land registery and experian and i was not liable to pay the charges so they have been dropped. I have just realised that i will still have a CCJ against me or my property and over the last eleven years i have taken out a loan at a high interest rate and a mortgage at a higher interest rate because of the CCJ. I could not believe that a customer care assisstant could resolve the problem in 5 minutes yet the company legal team could not and took me to court twice without checking the information in my letter sent in 2005. What do ido now?

    Well first off you need to get it in writing that that charges etc have been dropped.

    With regards to the CCJ, when was it? And how come they managed to get a CCJ in the first place, did you not defend the claim?

      Thanks for your reply Wendy b I will be sending a letter to Northumbrian Water asking for confirmation in writing that they have dropped all charges.
      I did not write to Nottingham court to contest i think it was in 2005 origionally then 2009 i just thought it would go away as many people do.
      Hopefully i can get the CCJ removed by writing to the court after i have recieved in writing that the charges have been dropped. Thanks again for replying.

        well tbh I can't see much chance of getting the original CCJs set aside or struck out unless you have very good reason, ie you didn't know about them, they were sent to wrong address etc. Telling the court that you hoped it would go away probably won't do the trick, unfortunately. Although there are others on here who are more expert in these matters and may be able to advise.

        CCJ's don't go away. If you do nothing about them ie don't defend them, the other party usuallyautomatically gets judgement against you.

        What are you hoping to gain from this now? What is your ideal end result?

        Other thing is, was this a new case? becuase they can only "drop charges" ie withdraw the claim, relating to now, they can't withdraw previous claims because judgement has already been made on them. There may be some redress going back hsitorically but as i said above, I'm not sure what that is.

          Hi Wendy b i just want the CCJ to be removed and Northumbrian Water to compensate me for harrassing and ignoring me for eleven years. The charge was for another property that i moved out of eleven years ago. It took a customer service assisstant 5 minutes to resolve but Northumbrian Waters legal team have taken eleven years to do nothing but harrass and intimidate me.

            So what steps have you taken in the intervening 11 years to stop them from harassing you? I would suggest that defending the two court claims might have been a start. Because if you contend they were harassing you, then surely by not defending the claims then you have been complicit in allowing them to carry on? What correspondence have you had in the menatime between the water company and yourself and do you have copies/evidence of their harassment? I personally think you won't get much from them in the way of compensation as you have allowed it to go on this long. And until you have it in writing then you can't be sure that the customer service assistant has actually sorted it out once and for all.

                Hi all have found a interesting item on this site. Apparently i will be able to get the CCJ removed because Northumbrian Water sent the court summons to my eleven year old address. I will post decision as soon as i hear from the courts.Regards Banjoe:tinysmile_hmm_t2:

                  Northumbrain Water's (NWG) Chairman is Sir Derek Wanless. Sir Derek was ousted from the 'old' Board of Northern Rock Bank. A Select Committee Report found Sir Derek highly culpable for the crisis at Northern Rock. He was a Non-Executive Director, and Head of Risk. John McFall MP, who chaired the Select Committte summed up his feelings by saying "Sir Derek, you didn't do your job!" Sounds like Sir Derek is not passing muster at Northumbrian Water either.Sir Derek was CEO at NatWest in the 90's, before the hostile takeover by Fred 'the Shred' Goodwin. Oh - he was ousted from NatWest also ! I read a pejorative article recently, it was lampooning Sir Derek for cunningly airbrushing all reference to Northern Rock from his numerous biographies. So modest !

                    Hi all Wendy b seems to have been spot on i have recieved a letter from Northumbrian Water they have dropped all the charges £1,400 but they are saying they will not compensate me. I got what i expected but i have wrote a letter to the water council telling them what i think of NWater. All i wanted explained to me was how come it took a five minute phone call with a customer service advisor to resolve a problem that had gone on for eleven years?

                      Well that seems like a good result to me. They will no longer be harassing you and the threat of court action has gone away. If you can get the CCJs removed because the paperwork was sent to the wrong address then that will be a bonus.Now you've written and told them what you think don't hold your breath for any different outcome other than you've already got. Just move on and concentrate on something else now this is out of the way.
