  • ccj entered against me after requesting cca

    hi all,

i received a county court claim from lowell/overdales dated 13/02/2026 for an apparent debt owed to novuna personal finance for the sum of £929.50 with fees etc the total amount of £1266.83.

    the claim was acknowledged 17/03/2026

i sent a request for a copy of the consumer credit agreement to both lowell and overdales on 07/04/2026 sent next day recorded delivery, with the understanding that agreement should be supplied within 12 working days from the date of this letter.

on 09/04/2026 a judgement was made against me

a letter was received from overdales dated 21/04/2026
    below is what it said.

"we confirm we have raised a request with the original creditor for a copy of the agrement and statement. if available, these will be sent to you upon receipt.

as you will be aware, a county court judgment (ccj) in default was entered against you on 09/04/2026, due to your failure to respond to the claim form issued on 19/02/2026. our client is not obligated to prove this debt any further or provide any further documentation at this time as your failure to enter any defence or respond to our clients claim has proven our claim."

is this correct, do they not have to provide any documents even though they received the cca request the day before the judgement against me.

could i push this with the court or is it just a waste of time now and i will have to just pay the debt even though i have not seen any evidence as yet to show that it is owed.

    regards,

So you received the claim from the court and acknowledged it on 17/3/26. Apart from asking for the CCA what else have you done about the claim?
All opinions expressed are based on my personal experience. I am not a lawyer and do not hold any legal qualifications.

i acknowledged the claim, but thought that they would have to submit some form of substance to the claim for me to then answer too. i didn't think they could just make and claim with no kind of evidence.

so nothing other than acknowledgment and cca request. i am guessing that was a big mistake now
