  • Claim from Azzurro Associates for Capital on Tap Debt. Issues with statement request

    Hi All, been a few years since I was last on here but I am now dealing with the above.

    The claimant has sent me all the information that I have requested and I have queried the so called statements - "I am looking at the request for statement of account since inception.

    It appears that what has been sent is a spreadsheet on Azzurro headed notepaper with no details of the retailer etc that the card payment was made to?"

    The reply that I received was "When Azzurro buy a debt, it gets loaded onto their system and all of the transaction history gets copied over. This is why the statement appears to be an Azzurro document. However, all of the payments in/out between yourself and Capital on Tap have been captured and appear on the statement."

    My question is as to whether the lack of an actual statement from the originator and the lack of retailer details is a strong enough case to take up with the claimant and/or in any court hearing?

    Interest charges etc are all included and detailed

    So it's basically the original creditor transferring their computer records to the claimant's computer?

    They haven't emailed statements? If that is the case I wouldn't be happy with that, the data
    wouldn't be 'contemporaneous'. What if an error has been made during the transfer?
    Puts the 'accuracy' in doubt.

      Thank you and that was my thoughts. I have small claims mediation on Monday so I can mull this one over the weekend. Again, thanks for your time.
