Overdale discontinuance ERROR

The claimant initiated a court claim for £2k against me which I defended. The claim WAS discontinued against me by Overdales in April.

They’ve served me recently months later with a n244 asking the court to reinstate the proceedings as they say they did not intend to discontinue they did it in error!!

How is best to oppose this? Initially, I’m thinking the CPR rules allow a claimant to discontinue at any time.

Have you received any documentation from the Courts? Clearly when they ask for the case to be resisted, you'll be able to respond by making your case that it should be set aside. It's clearly 'unfair' on you.
