  • CCJ Withdrawing claim (PRA)

    Hi All & Happy NY,

    I was given a CCJ by PRA over a credit card debt in September 2024 that had been transferred to them in December 2023. I had been away in another location temporarily for an internship, thankfully I had a hearing a few days ago and the judge set aside the application immediately. Prior to knowing about the claim in place I had paid a £1 token payment in August 2024 and set up a £5 payment plan in the September before learning about the CCJ, but sadly it was too late to do anything about it aside from send off the N244.

    Now, immediately after my hearing the other day, I got in touch with PRA and requested if they would please consider withdrawing the CCJ claim as its now back to the defence stage. Debt is mine, I own up to that. I just had a very difficult year last year with redundancies, mental health (depression) and living in a house with people abusing drugs and was so focused on trying to secure other work and sort out living situation. I made a token payment of £1 in January 2024 and completely forgot due to the chaos of the year, only finding out about the claim after I returned from an internship September. They are aware of this entire situation.

    I have been on an ongoing payment plan since September, paying since August - and trying to sort out the situation for nearly 6 months.

    They got back to me today and offered a Tomlin Order for £119 which needs to be approved in court. I have written back to request again for them to reconsider as currently I am on universal credit and its a huge expense for me right now. I already have a plan in place and see no need for them to take it further when I have been consistently paying, if anything it just seems like wasted time and extra costs. Though I understand they want some protection. I have mentioned this in a second request to withdraw in my response.

    My mental health at the moment feels completely shot, I'm trying to better myself through a course during the day and I'm living in a hostel and don't feel like I'm doing so well if I'm honest. I'm completely beside myself for letting it get to this point I am hopefully moving on to a house share when I get a job and obviously cannot have a CCJ in my name if I want to get accepted anywhere and cannot understand why, given there's a plan in place they still want to pursue action against me.

    I know they aren't obligated to do anything else for me, but I'm just wondering if there's anything else I can say or do that would help my case here?
