    Hello there

    I am new here and wondered if someone could please give me a little advice.

    I received a letter from the Civil National Business Centre regarding a claim by the PRA Group. I responded to the claim online completing the Acknowledgement of Service and checked that I intended to defend the claim in full. That was on the 10th November 2024. The Acknowledgement was received on the 11th November.

    I was waiting for a "this is a defended claim" letter or email but received nothing. I also received no correspondence about a hearing/.court date. The next thing I know today, I received a letter from the CNBC stating Judgement for Claimant (in default). How can this be?

    Surely I should have received correspondence regarding any hearing? I had sent a request to the PRA Group asking for proof of debt owing but received no reply.

    This judgement is for several thousand pounds and I do not believe I am responsible for it. The debt is over 6 years old.

    Any advice would be really appreciated.

    Welcome to LB

    You Acknowledged Service of the claim, that gives you 28 days (plus 5 days postal) to lodge you Defence with the Court? Did you lodge your Defence with the Court.

    That is the next, Acknowledgement of Service gives you an extra 14 days to lodge your Defence with the Court.

    Is the reference to '6 years', that their claim maybe statute barred?

      Hello and thank you for your fast reply.

      I had sent my evidence to the court on the 2nd December but have a feeling that I only sent it first class and not signed for.
      Having said that, surely it would have got delivered.

      I had also sent a letter to PRA regarding the debt but received no respone.

      Am I able to have this judgement set aside? I am willing to pay the £300 fee as I do not see why I should be owing on a debt that is over 6 years old

        You need to be sure that, the debt is Statute Barred.

        That no payments or written acknowledgement of the debt has been made in the last 6 years (also that there is no CCJ for the debt). If that is the case then you can make an application to the Court to set the Judgement aside. What I would do, is contact the Court, give them dates, explain that it was sent. See if there are any notes on their systems, maybe an error. State that you want to set aside the Judgement.

        When ever you post something, make sure you get Proof of Postage.
