    Did you send a copy of the Defence to the solicitor?
    "....request default judgement......" in their letter appears to mean they haven't received your defence.
    What is the date of the solicitor's letter?

      I did think the same, but Defence was submitted via MCOL, post 9 on thread.

      I'm just thinking Kearns has got themselves 'confused'.

        Post 9 states OP received an acknowledgement letter from the court. No mention of MCOL

          thank you both.
          to clarify i didn't send a copy of my defence to the solicitor, i submitted it on MCOL and had a letter from court saying they would serve a copy

              Hi

              I am trying to create a post but am struggling

              I am in the exact same situation

              court have sent a a directions questionnaire how should I approach mediation

              debt with them was 3.3k but docs they sent me says 10k and it’s just the credit card agreement and says they did comply with notice of assignment.

              i want to settle what should be my opening gambit with them

              any advice would be greatly appreciated

                    Today I've received a letter from Kearns & a proforma giving me 7 days to reposnd.
                    see attached

                    even though the credit agreement isn't sign
                    I don't want to have to be filling in court forms and turning up at a court to argue the case as my mental health can not take it

                    I'm prepared to sign the proforma and offer £5.00 a month ....would that mean I will have a ccj?

                    It says there are alternatives options to this and to call them, would I be better to do that before signing the proforma

                      Even if they've sent documentation, the documentation needs to be compliant, they don't need the signature to be on the 'reconstructed agreement'.
                      There maybe other anomalies. You won't get a CCJ if you've settled the matter. You could pay a monthly amount, but if your health / circumstances aren't
                      going to improve, at some point you need to ask them to write off the debt. The last thing you need is more stress.

                        May be try and ask them for a 90% discount. These debt collection agencies are just leeches. Profiting from other people's misfortune.

                          if I can send a letter is there a template for guidance please

                            You really need to do one or the other. But not both together.

                            Call them, see what they say, tell them you can provide Doctors letters etc.

                            If they say no, then then complete the form.

                              Hi, as an update. I emailed Kearns Solicitors back in March to explain my situation and enquiring if this could be written off. Also posted them a copy of the email in April as I had not response
                              Its now been just over 4 months and I've had no reply from them or anything further from the court

                                Ring the Court, find out what the 'status' of the case is. The case maybe 'stayed'.
