  • Simple Procedure claim received

    I received numerous letters from PRA re. credit card debt with Barclaycard.

    Opened: 2015
    Last payment: 2022
    Defaulted: late 2022
    Value: c£4k

    I received a letter before action from PRA in early October, which I replied with a CCA request.
    Received a reponse within a few days confirming receipt, and that they have requested the documents. Account placed on hold until received. Nothing received yet.
    However I've just been served a simple procedure claim by Brodies on behlaf of PRA Group. I have until the end of the month to respond.

    Section E1: 'A copy of the agreement will be produced'.

    My intention was waiting until PRA had fulfilled the CCA request (if they ever did), then arrange to pay.

    What should I do - and in what order?

    Do I contact PRA and question why they have instructed Brodies to initiate court proceedings despite being told the account is on hold?
    Do i dispute the claim, on the basis that the documentation has not been provided? If so, do i put that in on the final day - assuming documents not received?

    Any help or advice would be greatly welcomed.

    no they are trying to be clever the request is outs standing they know it, if they send court form(Trouble PRA ignorant) they more like will then you would request CPR31.14 asking for documents listed in court form. but latter CCAs can be a problem signed on line> see what they send next, no contact with PRA they will fob you off.

      Thanks for the prompt response.

      Just to confirm, I have received the court claim form (3A) which states a copy of the agreement will be produced in section E1.
      E4 confirms date of agreement, £s and claimant agreement reference.

      I have until near the end of December to respond.
      PRA haven't fulfilled my CCA request to date.

      What should I be doing now? Is it in my interest to respond and contest the claim asap - do i wait until the final day - or does it not make any difference?
